The following information is provided as an overview of new and ongoing land use and development proposals within your Community Council District.
Those that are subject to Community Council review and comment (zoning and conditional use applications, including Planned Unit Developments (P.U.D."s), which are subject to conditional use approval) have most likely already been referred to your Chairman or other designated representative for consideration by your Community Council at its next regularly-scheduled meeting.
You might also have already met with the applicant or authorized agent for many of the applications listed by virtue of a prior referral from county staff or contact by the applicant.
Your review and comment on matters subject to Community Council input is most constructive when it highlights area characteristics in the vicinity of a proposed development and specific impacts that are reasonably likely to result from that development proposal if implemented. These typically include traffic; lighting; noise; odors; drainage; loading and unloading facilities; land use compatibility; density; building height; safety; etc.
With such information conditions of approval to mitigate anticipated impacts can be timely incorporated into staff’s review and recommendations.
Impacts that can be legally mitigated with conditions of approval must be directly attributable to the land use proposed. In addition, those improvements or plan modifications required as conditions of approval to mitigate those impacts must be proportionate to the impacts generated.
Compliance with adopted ordinances and standards is required in all cases.
Although not subject to Community Council review, proposed subdivisions, single family residences, accessory structures and land uses permitted by right within the zoning ordinance are also presented for general information.
Variance requests, which are by law quasi-judicial and not subject to review by either Community Councils or the Planning Commission for your area, are instead considered and acted upon by the Board of Adjustment, a quasi-judicial body whose decisions are subject to District Court review upon appeal. Variance requests, therefore, are not included in the following listing.
